THECAVIARHOUSE is a brick and mortar store in Mykonos that also delivers caviar in the EEC countries via the caviar house e-shop www.thecaviarhouse.com. The owner of this Website is the company under the name “CAVIAR SINGLE MEMBER PRIVATE COMPANY”, based at Mykonos Greece, Epano Vrysi 84600 Greece, Tax Registration Number:801180240, Tax Office: Mykonos (hereinafter referred to as “THECAVIARHOUSE.COM”, “THECAVIARHOUSE”, “CAVIAR”, “we”, “us” ), which is also the Website administrator.
1.2. Access to this Website and to the products and services offered through this website (hereinafter referred to as the “Services”), the use of these as well as the execution of transactions are subject to these terms, conditions and notes (hereinafter referred to as the “Terms and Conditions”). By browsing the Website and using the Services and/or proceeding to transactions of Products, you consent to the current Terms and Conditions in their entirety, as well as to their occasional updates, which govern the relationship between yourself and us. In case of disagreement or reservation on your part regarding part or all of the present terms you can contact our customer service team, referred to as Contact or Concierge through the Contact section, before browsing or using the Services or realising a transaction. Otherwise the acceptance of all terms by you is unconditional.
1.3. You should visit this page regularly to check for any changes made to the Terms and Conditions. Please note that any changes in terms do not refer to orders you have already placed, but are valid for the future. Our company reserves the right to amend, update or upgrade at any time, without prior notice to the user/consumer/visitor/member/buyer/client/customer (hereinafter collectively referred to as "the user") of THECAVIARHOUSE (as a whole or on an either/or basis): a) part or the whole of these terms of use, b) part or the whole of THECAVIARHOUSE’S content and c) part or the whole of the exterior appearance (interface), the structure or composition (configuration) of THECAVIARHOUSE and its technical specifications, as well as limiting access to the entire website or part of it and/or part of it becoming available by subscription. The company also reserves the right at all times, without justification and without prior notice to THECAVIARHOUSE’S user to cancel, suspend or terminate THECAVIARHOUSE’S operation. Access to this Website is allowed under the present terms and conditions and we reserve the right to remove or change the Services without prior notice.
1.4. This Website also contains links to other Websites, which are not operated by THECAVIARHOUSE’S family (the “Linked sites”). THECAVIARHOUSE has no control over the Linked Sites, and does not guarantee the timeliness, accuracy, legality, completeness or quality of their content and accepts no responsibility for them or for any loss or damage that may be caused by their use. Your use of the Linked Sites will be subject to the terms and conditions applicable to each website.
1.5. By registering on our Website you automatically become a member of THECAVIARHOUSE Newsletter user list and enjoy any privileges provided to our Newsletter user list. At the same time, you agree that you have read and accepted the terms and conditions of our Website. In case you wish to be removed from our Newsletter user list you can contact our Concierge and customer service team through the Contact section or opt out by clicking the unsubscribe button on our email.
1.6. It should be noted that the Contact section and any Frequently Asked Questions section are displayed for the sole purpose of providing online help and information and by no means substitute the “Terms and Conditions”. Our Privacy Policy and any other Legal terms section constitute integral parts of “Terms and Conditions” and are totally binding for the parties (the company and the users) under the terms of article 1.2. above.
2. Description of transactions and services
2.1. THECAVIARHOUSE online store reserves the right to select freely the products that it displays on its Website and to modify, update and/or withdraw these at any time and without prior notice. The same applies to its pricing policy; it may select and implement freely any deals and discounts, and it may modify, update and/or withdraw them at any time and without prior notice and/or subject to any deadline, as long as it informs the users as and where it is provided by the law.
2.2. In addition, THECAVIARHOUSE website features videotaped and photographed recipes and food preparation recommendations based on the products sold on our website to which all users have access exclusively for domestic use. The Website content and recipes are intended exclusively for consumers who are above the age of eighteen (18). The result of the execution of these recipes cannot be guaranteed, even if all steps are followed according to the instructions given by us or the producer. The consumer is solely responsible for the result or any problem that may arise whilst preparing a recipe. In short, each recipe is provided “as is”. The additional information about each product must always be taken in serious consideration, whether it refers to storage, consumption, cooking, or any other possible use of such product, as well as to the properties of the devices and other tools used for the execution of the recipes.
3. Privacy policy
Our Privacy Policy , which explains how we will use your information, can be found in the section entitled Privacy Policy . By using this Website, you agree to the content of said section and guarantee that all data provided by you is accurate, true and up to date.
4. Prohibitions when accessing and using the Website
4.1 You shall not misuse this Website; you shall not hinder or interfere in any way with the operation of the website or replace or modify its content. You shall not commit or encourage a criminal offence, transmit or distribute viruses, trojans, worms, logic bombs, or post any other malicious or technologically harmful material and you shall not commit any actions that can lead to unacceptable or extensive damage to the infrastructure or operation of the website. Furthermore, you shall not use the website in breach of confidence or in any offensive or obscene way.
4.2. In addition, you shall not hack into any aspect of the Services, corrupt data, cause annoyance to other users, violate any other person's proprietary rights, send any unsolicited advertising or promotional material, commonly referred to as "spam", or attempt to influence the performance or functionality of any facilities of or accessed through this Website. Any breach of this provision shall constitute a criminal offence under Greek legislation. THECAVIARHOUSE will report any such breach coming to its attention to the relevant law enforcement authorities and will disclose your identity to them under the conditions of the law.
4.3. You may connect to our website under the terms of articles 5.5. and 15 with your own means and via companies and providers of your choice.
5. Intellectual Property, Software and Content
5.1. The website www.thecaviarhouse.com is the official website of THECAVIARHOUSE. The intellectual property rights of all the software, written and media (including photographs and videos) content you access on or through this Website remains the property of THECAVIARHOUSE or its licensors and are protected by international copyright laws and treaties on intellectual property rights. All such rights are reserved by THECAVIARHOUSE and its licensors.
5.2. Under no circumstances should the display and view of the Website’s content be construed as a transfer and/or cession of authorisation and/or its right of use to anyone. You may store, print and view the available content solely for personal use. You may not publish, handle, distribute, copy in whole or in part, transfer, alter, store, re-publish, modify or otherwise reproduce, in any format, any part of the content or copies of the content provided to you or featuring on this Website, nor may you use any such content in relation to any business or commercial activity without THECAVIARHOUSE written permission.
In addition, you may not modify, translate, reverse engineer, rebuild or create derivative works using any software or accompanying documentation offered by THECAVIARHOUSE or its licensors. Moreover, you are not granted any license or consent to use THECAVIARHOUSE logo and trademarks in any way, and you consent not to use such trademarks or any trademarks which are similar in colour, without THECAVIARHOUSE written permission.
5.3. Photographic representation of our products: We have made every possible effort to ensure a realistic and accurate photographic representation for the majority of the products sold through our Website. Yet, due to technological limitations, these representations may vary from the actual condition, form and image of the products. This is absolutely natural given the limited technological possibilities, even when using the latest technological developments in the field of photographic representations.
Please note that, although THECAVIARHOUSE has tried to accurately display the colours of the products, the actual colours you see will depend on your monitor specifications and therefore may not be accurate.
5.4. We do not claim or guarantee the accuracy or reliability of any of the information or content regarding any goods or services, software or advertisements contained on, distributed through, received by or linked and accessed through this Website.
5.5. Website access license: Users are hereby granted a limited license to access and make personal use of this Website, but not to download or modify it, or any part of it, except with THECAVIARHOUSE’S express written permission. This license does not allow for any resale or commercial use of this Website or its content, any collection and use of any product listings, descriptions, or prices, any derivative use of this Website or its content, any downloading or copying of account information to the benefit of another merchant, or any use of data mining, robots, or similar data gathering and extraction tools.
5.6. It is prohibited to reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit this Website or any part of it for any commercial purpose, without our express written permission. We have exclusive rights to the domain name of our firm and all brands represented on our site are rightfully subject to lawful protection.
5.7. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including videos, images, text, page layout, or form) of the Website of THECAVIARHOUSE and its affiliates without our written permission. You may not use any “meta tags” or any other "hidden text" based on names or trademarks of THECAVIARHOUSE or its affiliates without our express written consent. In case of unauthorized use, the license granted by THECAVIARHOUSE is terminated.
5.8. You may not use any logo or other proprietary graphic or trademark of THECAVIARHOUSE, or open source code or part of the link without our prior written consent.
6. Terms of sale
6.1. By placing an order you agree to purchase a product according to the following terms and conditions. We accept and monitor orders within local working hours (10 am - 5 pm). We usually dispatch products only to member states of the European Union (see Shipping Policy in article 8). For deliveries outside the European Union, you may submit a wish request, by contacting our customer service team via the Contact page section. If you reside outside the European Union and your request is verified through a special procedure and deemed feasible, the approval of your order will be confirmed and your product(s) will be shipped. In particular, deliveries outside the European Union will be processed in a special procedure in order to be approved or rejected and our customers will be informed regarding the acceptance or rejection of their request by e-mail within ten working days. Please note that the automated message which appears on the screen with the details of your order request received by our company does not constitute acceptance of your order, but it is received subject to the above procedure. In case of acceptance, you will receive an order confirmation email, according to the above, which should include the details for the checkout through payment.
Depending on the legislation of each country outside the European Union, there may be restrictions on the sale of certain products or the sale of certain products may not be allowed at all. You will be notified by email in case of such a problem.
6.2. In order to offer you a better and more complete service and facilitate your future purchases, when placing your first order you either register your personal account on thecaviarhouse.com as user, providing us with all your personal details requested in the corresponding registration form or proceed to your purchase as a guest. Each time you complete a purchase, you fill in all the details of your order request which appear on the checkout form. All information sent to our company is managed exclusively by authorized company personnel, falls within the Privacy Policy of our company and is collected and processed with the ultimate safety and care. In any case, every time you send an order request to our company you must first have accepted these Terms and Conditions, which govern the transactions between yourself and us in their entirety as mentioned in Article 1 above.
6.3. THECAVIARHOUSE orders are shipped Mondays and Tuesdays only in order to ensure timely delivery of our fresh and sensitive product. For this reason and to keep you fully informed and protect you in the best possible way against unforeseen circumstances, orders are completed as follows:
6.4. i) Upon completion of your order request, your total aggregate order will appear, including all the details of your request. If you proceed to the stage of completion of your order, you will be connected to the third-party payment service provider to complete the payment of the agreed price under the terms of the following section (ii) as well as article 9 below. Upon successful completion of the payment, you will receive an automated e-mail confirming your order, which will also be sent to the email address you have indicated.
ii) To ensure the highest possible security of your transactions, our Company may (but is not obliged to) carry out a control through the collaborating payment service providers as to the correctness of the payment information you have sent us (in case of credit card payment or payment through a third-party online payment service provider) upon completion of your order and connection with a third-party payment service provider. Our Company may reject your order if there is any problem or even the possibility of any problem arising regarding this information.
6.5. i) After that, your order proceeds to the stage of collection and you will receive an e-mail when the products are ready to be shipped to the indicated shipping address (or in case of multiple deliveries, to the shipping addresses). The delivery of your products is subject to the Terms of article 8 below.
ii) In case there is an unexpected shortage, for any reason, in one/some of the products you have ordered and/or a product will be available after the time of delivery stated on our online store, or in case there is a problem regarding the products included in your order, our Company will make every possible effort to contact you either by e-mail, via the email address you have indicated, or calling you directly through one of its representatives (or in all of the above ways) to consult with you for any modification, correction or cancellation of your order. In case we have not been able to contact you for up to 7 calendar days, then your order will be executed for the part which is available and it will be cancelled for the rest of it. In any case, you will be notified of any modification of your order again by e-mail, via the email address you have indicated. This email will also constitute a confirmation of your order based on which your order will be executed. The shipping of the products will be carried out according to article 8 below.
6.6. Please note that shipping times may vary depending on the availability of the products and date/time your order was placed (we ship only Mondays, Tuesdays). Delivery times are subject to delays caused by courier delays or force majeure for which we cannot be held responsible. Within the European Union, we ship overnight and you should expect to receive your order within 24-48 hours the latest from the time it was shipped. Please check article 8 on our company’s Shipping and Delivery Policy for further information.
6.7. After receiving the confirmation email we are happy to provide you with the airwaybill tracking number and check the status of your order (in transit) through the courier service website.
6.8. In order to implement a transaction at THECAVIARHOUSE you must be over 18 years of age. Visitors under the age of 18 should not exchange data and any information with us. When placing an order, you undertake that all details you provide us with are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. In any case, the Company reserves the right to proceed to the controls referred to in article 6.4. II) above.
6.9. Please note that, due to the nature of our products, which consist of products that are fresh, sensitive and expire soon, it is the customer’s responsibility to store the product properly by placing it in the fridge (NOT freezer) straight upon arrival to keep it in perfect condition. Please remove the insulating box before placing it in the fridge.
6.10. i) All items are intended for personal use only and not for re-sale.
ii) Users who register on our website as professionals bear the responsibility for the correctness and legality of the information they state on our website as well as for making transactions. By registering on our website as a professional you solemnly declare to our Company that a) you represent or are entitled to represent the legal person in this transaction and that you bind said person and b) that you are personally responsible for tax compliance and any police market provisions that may apply to your business, as well as all the rules for storage, conservation and delivery of these products.
6.11. We accept and monitor orders within local working hours (10 am - 5 pm). When you place an order, you will receive an e-mail confirming that we have received and accepted your order. The product purchase contract will be drawn up only after your payment has been authorized and the amount has been charged to your credit card, debit card through our secure payment processor, Stripe, or PayPal account, or when the Company’s bank account is credited with the total amount due. In case of cash on delivery, the products are delivered with retention of ownership (cash on delivery applies only to deliveries within the Attiki prefecture, Greece. In case you select the account deposit payment method, the order will not be executed until the company’s bank account is credited with the total amount due.). Please note that we only accept Euro for cash on delivery or cash payments.
6.12. During the processing of your order you will receive a number of automated emails informing you on the progress of your order.
i) These emails concern the following steps:
a) Order confirmation: as provided in articles 6.4 and 6.5. above
b) Order processing: When the products of the order are ready to be shipped to your address, along with the consignment note.
c) Collection by customer: The order has been delivered to the designated address, including the receipt/invoice.
d) Incomplete order: You will be notified in case one/some of the products of your order has/have not been collected and the order has remained incomplete.
e) Cancelled order: In case your order has been cancelled
ii) In addition, in case anything is missing or a problem occurs while processing your order, you will receive a corresponding e-mail and/or we will contact you by phone, via the phone numbers you indicated when you registered or when you placed your order on our website.
6.13 By sending an order request you consent to receiving the above notices, which are a precondition for the proper progress of your order. You should make sure you can receive these e-mails and store them throughout the duration of our transaction. In case you are not receiving these e-mails, you have to contact our customer service team through the Contact section. The parties agree and acknowledge that the communication described in article 6.12 and the pattern of said communication (by e-mail or telephone) also covers the legal conditions of your written briefing, your notification, the confirmation of your order, so far as is required by law. Should you wish to object, or to ask for clarifications regarding the content of an e-mail you have received as mentioned above, or for any other reason, you may contact our customer service through the Contact section.
7. Pricing
7.1. THECAVIARHOUSE users consent to the company maintaining the general right to change freely its pricing policy, to modify the quoted prices on the website and to change and/or withdraw the offers at any time, with or without prior notice to THECAVIARHOUSE users, who will be informed on the current price through the relevant posting on the website. Whilst we try to ensure that all details, descriptions and prices displayed on this Website are accurate, errors may occur. If we notice an error in the price of any of the products that you have ordered, we will inform you as soon as possible and give you the possibility to reconfirm your order with the correct price or cancel it. If we cannot reach you, we will treat the order as cancelled. If you cancel your order as per our Terms and Conditions, but have already paid for the products, you will receive a full, interest-free refund.
7.2. All prices are displayed in EURO and are inclusive of VAT (Greece). From June 2021 onwards, VAT rate will be adjusted to the VAT rate applicable in the country where the product will be shipped, as per the latest EU regulation. Shipping costs will be additionally charged and you will be notified of the cost when placing your order. Any additional charges that may occur are clearly displayed and included at checkout.
7.3. The Website may contain typographical errors or other errors or inaccuracies and may not be complete or updated to the last detail. We therefore reserve the right to make corrections to any errors, inaccuracies or omissions and to change or update information on the Website at any time without prior notice. We also reserve the right to refuse to process any orders that you have placed based on information contained in the Website that may contain errors or inaccuracies, including, inter alia, errors, inaccuracies or out-of-date information about pricing, shipping, payment terms, or return policies.
8. Delivery/shipping of products
8.1. For the utmost freshness and quality, all of our products are dispatched on an overnight delivery service with gel ice packs and thermo-insulated packaging keeping items perfectly chilled for up to 24-48 hours. Orders are dispatched only Mondays and Tuesdays.
8.2 Time, Means, Place of Receipt/Delivery: The delivery time of your order is determined by its finalisation as well as the order confirmation e-mail received upon its completion.
In case you wish your order to be dispatched to an indicated delivery address, the delivery will be carried out:
a) By a partner transportation company. Our company and its partners take all necessary steps to ensure the timely delivery of the order to the buyer based on the basic delivery schedule of each transportation company. We cannot guarantee neither the arrival time nor the exact delivery time of the ordered goods, as it depends entirely on the transportation companies that we collaborate with. Our company is not accountable for any delays caused by force majeure or unexpected events or events beyond its control. In the event of any delay, our company will make every possible effort to contact you. Our company is responsible for the proper delivery of your order to the carrier, and, from that point on, the liability lies with the buyer subject to article 524 AK. The transportation cost is defined by the pricing policy of each transportation company, which is solely responsible for shipping charges and which may alter the relevant prices at any time. THECAVIARHOUSE is not liable for any such pricing change.
b) With our company's vehicle, only for deliveries within the Attiki prefecture, Greece. Our company takes all necessary measures to ensure the timely delivery of the order to the buyer within its basic delivery schedule. We cannot guarantee neither the arrival time nor the exact delivery time of the ordered goods. Our company is not accountable for any delays caused by force majeure or unexpected events or events beyond its control. In the event of delay our company will make every possible effort to contact you.
c) Gifts orders: You can also order one or more gifts and send them to any recipient you wish within the European Union, simply by filling out the recipient's address and information in a special form on our website, so that the product can be delivered directly to him/her. When sending gift parcels to other recipients, make sure the recipient can receive gift parcels and that, generally, the gift will not be considered undesirable for any reason, nor will it be rejected upon delivery, otherwise the product will be shipped to the billing address under the responsibility and expense of the buyer.
d) General Specification for all deliveries: While we make every effort to send you your order as soon as possible, because of the nature of the product it is important the package to arrive at your site latest 48 hours after being dispatched. Normally, it happens within 24 hours. This is the reason why we dispatch on Monday and Tuesday only. We do not dispatch during weekends or official public holidays and the dates following these holidays. But there are exceptions: In case you really want a delivery during the weekend or on a public holiday, you have to consider reasonable surcharges the courier service claims. In this case we kindly ask you to contact us directly by telephone or email to find an acceptable solution.
If you are not home to receive your order, please leave a signed note to tell the courier where he/she can place or deliver the order close to your house. You are responsible for the delivery after that.
If your order has not arrived within its allotted time frame, please check with the delivery company using your tracking number, or contact us as soon as possible.
g) Subject to any special charges for the transportation and delivery which will be expressly mentioned for a product listed on our website, the general pricing policy is the following:
i) There is a flat shipping rate of €30 for all orders within the European Union (delivery by UPS) excluding Greece. The shipping cost will be included in your order at checkout.
ii) For shipping within the Attiki prefecture of Greece, with our own transportation means, delivery is free of charge. We do not ship to the rest of Greece, unless we have agreed otherwise through our direct communication. Shipping cost will be specified at this communication.
For deliveries outside the European Union, you may submit a special request, by contacting our Contact section. In case you reside in a country outside the European Union and desire delivery within a European Union country, please select delivery within the European Union your order will be processed as a matter of course.
Orders exceeding Eur 300 delivered within the European Union are subject to complementary/free shipping.
Please note that all the above-mentioned prices are subject to change at any time.
8.3. Free shipping: For Deliveries within the European Union
i) Free shipping for deliveries within the European Union applies only to orders over €300 (including VAT) and for deliveries within the Attiki prefecture. Free shipping excludes deliveries to “inaccessible destinations” and hard-to-reach regions within the European Union, where there will ba an additional “inaccessible destination fee” as determined by our courier provider. Please contact us if you require any clarification.
ii) This service is NOT applicable for countries outside the European Union (EU).
8.4. If you are not at the delivery address to receive your parcel at the time of delivery, the distributor will leave an information note with instructions on how to collect your order. In this case, the risk of loss or damage of goods is transferred to the buyer, taking into account the vulnerability of goods as expressly mentioned above. We strongly recommend if you are not home to receive your order, to please leave a signed note to tell the courier where he/she can place or deliver the order close to your house. You are responsible for the delivery after that.
8.5. Customs: i) Furthermore, please note that products delivered outside the European Union (EU) may be subject to custom clearance and relevant fees; the company cannot be held liable for any other costs that may be added to these subject to different national legislations. We cannot know in advance what these charges may be; on the contrary, the consumer is in a better position to have knowledge or be aware of them or, at least, of the possibility of their existence and, for this reason, we recommend you check this possibility before placing an order on our website.
ii) Each country has its own customs policy, so you should first contact your local customs office for further information. Additionally, please bear in mind that, when ordering from THECAVIARHOUSE.COM, you are considered the importer of goods and must observe all laws and regulations of the country in which you are receiving goods.
8.6. If the ordered product is not available due to force majeure or unexpected reasons for more than 30 days (after the order confirmation), for example due to, including but not limited to, production shortages or inability of the supplier to fulfil the order, our Contact will contact the customer to deal with the problem. First, the same product or a product with a different trade name or a product from a different category or a substitute product will be suggested to the consumer. If the customer does not agree to proceed to another purchase, full, interest-free refund will be offered within 30 days.
9. Gift Cards
9.1. Gift Cards are sent only electronically via email to third party recipients you indicate to us. Any user who indicates a third person for the delivery of a Gift Card bears the responsibility for the accuracy of the information he declares to us. You cannot exercise the right of cancelling or returning the Gift Card itself or for products purchased through the card.
9.2. Please ask the recipient to check that their Gift Card is not caught in their junk mail, spam or firewalls. If it is not and they cannot view the email, please contact our customer service team as soon as possible through the Contact section for help. The Gift Card may, upon your request, be set to be sent to the recipient in a specified future date.
9.3. Please note that you cannot use (redeem) many gift cards for one order. For each order you can only use (redeem) one Gift Card. The total value of a gift card must be fully used in one order, therefore you cannot use (redeem) part of a gift card value in an order and you cannot purchase products of lesser value than that of the Gift Card. If a user places an order and makes a transaction using a gift card, it is understood that all the present Terms and Conditions apply and the same procedures provided for the purchase of products must be followed.
10. Payments
10.1. In order to serve you in the best and most thorough way, our company offers a choice of payment methods for the products you are interested in buying. In this context, we offer you the possibility to choose, as described below, the payment method for the products you are interested in buying, i.e. a) via credit card, debit card and wallets (i.e. Apple Pay) through our secure payment processor Stripe, b) through a third party online payment service provider, like PayPal for example, or c) as otherwise agreed. Please note that it is not possible to combine different payment methods for one order.
10.2. More specifically, we accept payments by all major international credit cards, debit cards and mobile wallets such as VISA, VISA Debit, MasterCard, PayPal and any other means of payment processed through our secure payment processor, Stripe. We also accept cash on delivery payments ONLY within Attiki Greece and without extra charge. We also accept direct deposits to our bank account. Please note that we do not accept cheques as payment for your purchases. For cash purchases please contact our Contact help desk.
10.3. Our prices are charged in Euro. If you select to pay with a card of different currency, then you will be charged with the applicable currency exchange fees as applied by your bank or the payment processor.
10.4. Provided that you have selected credit card as a payment method, the transaction will be executed and completed by one of our trusted third-party payment processors (such as Stripe or Paypal) or through our partner institutions which provide all the guarantees of security in electronic transactions. More specifically, your transactions in our electronic shop are protected by maximum online security systems (SSL). The collection and processing of the payment information you send us is done exclusively by the partner third-party payment processing platforms, which are solely responsible for their processing for the completion of the payment.
10.5. In case you choose to pay by credit card, you are advised to be present during the receipt of your order having your credit card or identity on you. If the order is placed under the information and on behalf of a company, you must use a corporate credit card. That is to say, it must be issued in the name of the corresponding company. Also, at the time of delivery, the authorized holder of the credit card is advised to be present with his/her credit card and identity. In any case, if a person who states that he/she represents you and acts on your behalf upon your verbal authorization appears at the delivery address you have indicated to the distributor, then the distributor reasonably accepts that that person acts in that capacity.
10.6. In case of payment via PayPal, you consent and accept that you are subject to the terms and conditions of operation of said online payment service provider, given that you have contracted with it upon your registration as its member. Our company is not responsible for PayPal's policies and operation. In case money is returned to you through a third party payment service provider (such as PayPal or credit cards), you may be charged with the commission charged by the specific third party provider based on its terms of use and operation, for which our company bears no responsibility.
10.7. Please note that payment upon receipt of your order at your site - CASH ON DELIVERY - only applies within Athens Greece, without extra charges within the Attiki prefecture. You pay our company's employee only in cash and in Euro upon the delivery of your order at your site, after having checked the product you receive. Cash on delivery cannot be used for multiple deliveries.
10.8. According to the current tax provisions, receipts of over €500 issued to individuals (Retail Receipt) and to professionals/enterprises (Sales Invoice) should be paid off ONLY in the following ways:

10.9. Discount vouchers, promotion codes, special offers: From time to time, we may offer promotional or discount vouchers, which will apply to specific purchases made through this Website. The discount vouchers, promotion codes and special offers cannot be combined with Gift Cards and cannot be used for the purchase of a Gift Card . The conditions of use of any discount voucher or promotion code will be determined at the time of their issuing and will clearly indicate their expiry date. Furthermore, the Free Shipping Service applies depending on the promotional activity and it does not apply to every case. In addition, we will run special offers, valid only when used individually. It will not be possible to use these offers combined with another offer, Gift Card, Discount Voucher or Promotion Code. We also reserve the right to withdraw an offer, discount voucher, promotion code at any time, due to limited stock availability and any other operational reason, or replace the product on offer with a similar stock item, where appropriate.
11. Cancellations
11.1 You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right to cancel, you must inform us through email at our Contact section of your decision to cancel this contract by a clear statement.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
11.2 If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery paid at checkout without undue delay and not later than 14 days after the day on which we are informed about your decision to cancel this contract. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
11.3 The right to cancel is excluded for contracts for the supply of goods which are liable to deteriorate or expire rapidly.
The right to cancel ceases to be available in the case of a contract for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery.
Due to the nature of our product, a refund cannot be guaranteed as we cannot be sure how the caviar has been kept and we don’t resell a product to another customer once it has been returned.
12. Order change/cancellation
12.1. An order change or cancellation (for a product or a Gift Card) can only be accepted if the confirmed order has NOT been dispatched, i.e. the order has not been completed. After order confirmation and even if the order has not been dispatched, the delivery address CANNOT be changed for security (anti-fraud) reasons.
12.2. If you are a consumer, you can exercise the right of rescission as set out in article 11 above, or follow the product return procedure as set out in article 13.

12.4. In case you require the return of part of the amount or the total amount paid to our Company upon the cancellation or change of your order as set out above, the relevant amount will be directly refunded to you in a manner to be agreed between us. In case you get a refund through a third party payment provider (like Stripe or PayPal, credit card etc. for example) you may be charged with the commission of the specific third party provider, based on its terms of use and operation, for which our company bears no responsibility.
13. Returns of products in the event of actual defect or lack of agreed capacity
As we want you to enjoy our product at its best, we recommend you putting your purchase in the fridge straight upon arrival to keep it in perfect condition.
Once opened, we recommend consuming our caviar within 1-2 days. For best before dates, please see each individual packaging.
Due to the nature of our product, a refund cannot be guaranteed as we cannot be sure how the caviar has been kept and we don’t resell a product to another customer once it has been returned.
13.1. We aim to provide 100% customer satisfaction. However, if you receive a wrong or faulty product, or in case of any other problem resulting from our fault, please contact our customer service team through Contact section for further details, so we can make suitable arrangements for an exchange, return and refund.
14. Disclaimer of liability
